Proposals are being invited for the permanent removal of the following Vessel which is located at Preston Marina, in Lancashire, England. The Vessel will be sold for the sum of £1 to any party who can satisfy the Vendor (Preston Marine Services Ltd. – PMS) that they will remove the vessel in its entirety from the premises of Preston Marina before June 30th 2019. Please read the full conditions of sale later in this document. The Vessel is a fire wrecked former 20 metre steel motor vessel named “Ocean Quest”, which was built between Dec 2002 – 2007 and wrecked by fire on June 24th 2007 (herein after referred to as “the Vessel”) This item (the Vessel) is being described as wrecked remains of a motor yacht, and is not to be considered fit for purpose as a motor yacht.
We (PMS) are not marine surveyors or boat builders and cannot make any comments regarding the Vessel’s structural integrity or seaworthiness and neither can we make any forecasts or estimates as to what work and/or investment would be required to make the Vessel fit for any given purpose. These details have been prepared in good faith and every effort has been made to ensure their accuracy but this cannot be guaranteed. No guarantees or warranties implied or otherwise are offered with the Vessel. Any prospective purchaser is strongly advised to engage the services of a marine surveyor and/or marine engineer to check the Vessel is suitable for their own intended purpose. Contents 1) Vessel design 2) Physical description of Vessel as at time of writing 3) Viewing the Vessel 4) Conditions of sale 5) Berthing and Subsequent Removal of the Vessel Vessel Design “Ocean Quest” was a Bruce Roberts “Euro 1900” design steel semi-displacement motor yacht with the following approximate dimensions; (taken from Bruce Roberts website); LOA (inc swim platform) 20.73m (68’) LWL 17.98m (59’ 1”) Beam 5.54m (18’ 2”) Draft 1.85m (6’ 3”) When the Vessel was launched (pre-fire) the weight was estimated to be around 55 tons.
“Ocean Quest” appears to be constructed from 5mm steel sheets for the hull (topsides only measured) and 3mm steel for the superstructure. This information is based upon our own observations and measurements prior to making this description. There are no engines fitted or available with the Vessel. 2) Physical description of the Vessel at time of writing The photographs included with this listing were taken in August 2018 for the purposes of this description. The final photo shows what the Vessel looked like in November 2006 when the boat was launched. 3) Viewing the Vessel Viewing the Vessel is available but the following restrictions apply; 1) Exterior only viewing is available by prior arrangement (min. 48 hrs notice) Tuesdays – Saturdays from 10am – 4pm. 2) Access to the Vessel is by a ladder from the quayside and should be considered hazardous – due to the state of the tide, on board viewing my sometimes not be at all possible.
3) Access should not be attempted by persons of restricted mobility. Persons under the age of 18 years old are not permitted. 4) No more than 4 persons must be aboard the Vessel at any one time. 5) A disclaimer must be signed by all persons intending to view the Vessel to acknowledge that viewing is at own risk 6) Suitable clothing and footwear must be worn by viewers. 4) Conditions of Sale 1) The Vessel is offered for sale subject to interview between PMS and potential Buyers.
2) Potential buyers must submit a written proposal which details their plan for the safe removal of the Vessel in its entirety before June 30th 2019. The sale will complete only upon the acceptance by PMS of such a proposal. A more comprehensive Method Statement and Risk Assessment may be required from the subsequent Buyer prior to the Vessel’s departure. 3) The Buyer must complete and sign a “Berthing Licence Application” with Preston Marine Services Ltd upon payment of the balance to buy the Vessel. 4) Title to the Vessel will be transferred by a Bill Of Sale to the Buyer only once completed and cleared funds in the sum of the agreed selling price are in place with PMS, as well as a completed and signed Berthing Licence Application as above, as well as a copy of these Special Conditions Of Sale to be signed by the Buyer.
This is considered to be the “Point of Sale” 5) The Buyer will be bound by the General Conditions of The Yacht Harbour Association, the Terms of Business of the British Marine Federation and the General Conditions of PMS. Copies of these are available by request. 6) The Buyer will be required to arrange for 3rd party insurance for the Vessel with a minimum liability limit of £3,000,000 while the Vessel is berthed on the premises of PMS. 7) The Buyer must permanently remove the Vessel from the premises of PMS in its entirety by 30th June 2019. 8) On the date of sale, The Buyer will place with PMS a surety bond of £2,000 which will be held in the brokerage holding client bank account of PMS.
This will be refunded in full upon the Vessel leaving Preston Marina (the premises of PMS) permanently by June 30th 2019. If the Vessel does not leave Preston Marina by June 30th 2019 this Surety Bond will be forfeited. 9) The Surety bond may be forfeited as a result of any breach of these Special Conditions. 10) If the Vessel is not removed from the premises of Preston Marina permanently by June 30th 2019 then the maximum length of any ongoing berthing contracts that may be offered to the owner of the Vessel subject to successful application will be one month at a time, and charged at our prevailing published monthly berthing rate. (£28.85 per metre per month inc.
VAT at the time of writing) 11) The Buyer may not advertise or offer to sell, re-sell or transfer title of the Vessel to any other party while the Vessel is on the premises of PMS without prior written consent of PMS and the payment of an administration fee to PMS of no less than £2,000. 12) The Vessel may not be dismantled or scrapped, either partially or fully, on the premises of PMS by the Buyer or any other party without prior written consent of PMS. 13) Hardstanding for the Vessel is not available at the premises of PMS. 14) All work activities must be contained within the Vessel itself. No use of the quayside adjacent to the Vessel or any other part of the property of PMS may be used without prior consent of PMS (which will not be unreasonably withheld), other than for temporary parking of up to 4 light vehicles (not HGV) at any one time 15) Consideration must be given to other customers of PMS, and local residents with regard to noise and unsocial hours working.
16) No third party may be engaged to undertake cranage of the Vessel, or parts thereof, without the prior consent of PMS and the possible payment to PMS of a license fee. 17) The Buyer must ensure that the removal of the Vessel does not result in any subsequent hazard to navigation or pollution of the waterway. The Vessel is being sold by PMS under Lien and the provision of the Torts (Interference With Goods Act 1977) due to unpaid berthing from the previous owner. PMS will sell the Vessel free from all encumbrances. 5) Berthing and Subsequent Removal of The Vessel The Vessel is currently lying alongside a quay wall in the tidal basin of Preston Docks, access to which is via property belonging to Preston Marine Services Ltd.
Berthing charges for the Vessel will commence from the Point Of Sale. Charges will be based on the annual published berthing rate at Preston Marina, which works out at £4,160.52 per year inc. VAT but will be charged monthly based on this rate, Pro Rata (£346.71 per month, Pro Rata from the annual berthing rate). A 25% DISCOUNT FROM THE ABOVE BERTHING PRICES IS OFFERED AS PART OF THIS SALE AS A GOODWILL GESTURE TO ASSIST THE BUYER IN REMOVING THE VESSEL. A single 16 Amp electricity supply can be made available by PMS to the Vessel on a metered supply at a cost of £25 + VAT per quarter plus the units used at cost price to PMS.
As stated in Clauses 2 & 7 of the Conditions Of Sale above, the Vessel must be removed from the premises of PMS by 30th June 2019. All aspects of the removal are the responsibility of the Buyer, and the method must be of their own choosing and arrangement. The dimensions and weights indicated in this document are approximate only and should be confirmed by the Buyer. It is our belief that the Vessel could possibly be made sufficiently seaworthy to be towed out by water, although this would need to be determined by the Buyer and/or the towing contractor. PMS cannot offer towing services.
It is also our belief that road transport may be a viable option for removal. In the case of road transport the load height would need to be minimised by partial removal of the superstructure. The height could also possibly be minimised by the removal of the steel keel plate, rudders and propellers below the waterline. This work would need to be undertaken by the Buyer. PMS can not offer lifting services but may be able to create space for a contract lift arranged by the Buyer – to be discussed and arranged by separate negotiation.
